Terms of Service
1. Who we are
Freighthouse Transport & Compliance ("Freighthouse", "we", "us") is developed and operated by Freight House, a GIC Company (ABN 72 149 866 375), 20 Mulgul Road, Malaga WA 6090. These terms govern your use of the Freighthouse application and services (the "Service"). By subscribing or using the Service you agree to them.
2. Your account
When you subscribe we create an operator account and an owner login. You are responsible for your account, for the accuracy of the information you provide, for the people you invite (your drivers and offsiders), and for keeping login details secure. Each person must use their own login.
3. Subscription and payment
The Service is billed monthly in advance, per truck, at the tier shown at signup. Payment is handled by Stripe; by subscribing you authorise recurring charges to your payment method until you cancel. Prices are in Australian dollars and may change on notice. There is no setup fee and no minimum term.
4. Failed payment and cancellation
If a payment fails we will retry it and email you. If it remains unpaid after our retry period your access is paused until the payment method is updated; your data is retained, not deleted. You can cancel at any time through the billing portal or by contacting us; cancellation takes effect at the end of the current billing period and is not refunded pro-rata.
5. What the Service does and does not do
The Service helps you record compliance activity (pre-starts, work and non-work time, fit-for-work declarations, licences, documents, defects, maintenance and incidents) and produce those records on request. It is a record-keeping and evidence tool. It is not legal advice, not a guarantee of compliance, and not an approved electronic work diary. See our Compliance Disclaimer. You remain responsible for your own compliance with the Heavy Vehicle National Law and any state law that applies to you.
6. Your data
You own the records you create. We process them to provide the Service, as described in our Privacy Policy. You grant us the limited rights needed to host, back up and display your data to you and the people you authorise.
7. Acceptable use
Do not use the Service unlawfully, attempt to access another operator's data, interfere with the Service, or upload content you have no right to. We may suspend accounts that breach these terms or put the Service or other users at risk.
8. Availability and liability
We work to keep the Service available but do not guarantee it will be uninterrupted or error-free. To the extent permitted by law, and subject to any rights you have under the Australian Consumer Law that cannot be excluded, our liability arising from the Service is limited to the fees you paid in the three months before the claim.
9. Changes and termination
We may update these terms or the Service and will give reasonable notice of material changes. We may terminate or suspend the Service for non-payment or breach. On termination you may request an export of your data within a reasonable period.
